Jumaat lepas, my FTB went to High Court for filing some document and he brought some template about Court Proceedings. So, after understand the contents I am glad for sharing with all of you about that. Here we go…

What is a trial??? Trial is a fact finding process before a magistrate or a judge where a decision is made in your case.

What is a civil claim??? It is a legal dispute between two or more parties. For examples damages for personal injuries, motor vehicle accidents, breach of contracts, property disputes and landlord and tenant disputes.

One may represent him/herself in court

If you want represent yourself in court, you must consider the complexities and specific issues involved when you decided to proceed without a lawyer. As your case proceeds, if you find that representing yourself is too difficult, you may engage a lawyer to represent you. HOWEVER, where the amount in dispute is LESS THAN RM5000 (SMALL CLAIM) you must represent yourself.

Corporate Bodies can only begin or defend a civil action through a lawyer. You should familiarized yourself with the relevant laws and procedures, keep track of all deadlines for filing and servicing of the documents to the other party and be prepared for trial.

A civil claim should be filed at the relevant court registry. A certain amount of fees must be paid. Then, once the claim has been filed you have to serve it to the other party within the specified time.

There are three (3) stage in trial. Pre-Trial, During Trial and Post-Trial

Pre-Trial

Ø Parties must file a bundle of documents and a bundle of pleadings which include among others statement of claim, statement of defence, counter claim (if any) and reply.

Ø Parties must exchange between them bundle of documents at least 14 days before the trial.

During Trial

Ø Plaintiff and defendant must attend during the trial.

Ø Plaintiff has the burden of proving his/her case.

Ø The plaintiff calls his witness to give evidence during the examination in chief. This witness will be cross examined by the defendant and later may be re-examined by the plaintiff.

Ø The defendant also calls his witness and has the burden of raising and proving any defences he may have to the claim.

Ø Once both parties have completed their cases, they will be asked to give their submissions.

Post-Trial

Ø A decision is pronounced in open court.

Ø If party does not obey the court’s decision, an execution order may be applied to the court by the aggrieved party.

Ø If the party does not satisfied with the decision, he has right to appeal it. For appeals to the High Court, he must file the Notice of Appeal within 14 days from the date of pronouncement of the decision at the registry of the court which delivered the decision.

semangat dari ayah

Last Saturday cik ayue balik kg coz rindu nk berpuasa ngan famili cik ayue…tapi x smua ade… my elder sis (ana) n younger bro (shukri) x balik coz my sis still kerja sambil belajar , my bro pulak cont study kat IKBN Temerloh…

Lepas balik dari terawih cik ayue pun borak2 ngan ayah…

cik ayue: ayah, ayu nak sangat wat bisnes…tp modal xdela…

dad: bagusla, plan slow2…ayah ade lesen kedai runcit…

cik ayue: aik bile mase ayah ade lessen kedai runcit…nape ayah x buka kedai runcit je??

Dad: mase bawa lori dulu, ayah selit skali barangan runcit…mane tau berguna…

Cik ayue: wah bestnye…jom r buka kedai lessen ayah hidup lagi kan…(time neh cik ayue dh happy bkn kepalang lg…semangat mau buka bisnes smakin berkobar2)

Dad: hidup lg la…rugi kalau x hidup…lesen kalau dah lame blh buat loan kat bank tapi ayah kene tukar alamat rumah baru ni la…

Cik ayue: ayah tukar la…bg ayu meniaga buat loan skali…hehehe…**bodek 2…

Ayah: nanti try la…

Wah epinye cik ayue x terkata…impian untuk wat bisnes makin hampr even buka kedai runcit pn xpe…cik ayue nak blaja dari bawah selok belok berbisnes…semoga cik ayue berjaya menggapai impian…AMIN~

Hye guys..arini cik ayue nak share 1 thing ngan korang…amekla iktibar dari ape yang dh terjadi kpd cik ayue…

Dalam cik ayue hepi2 lepas konvo terjadi pulak 1 kjadian yang cik ayue sendiri x sangka…

Cik ayue knvo 26/07/2010 (hari isnin) yang lepas di UMT, cik ayue balik Terengganu awal tau 20hb mlm cik ayue n kwn2 dh naik bas coz esoknye kami nak g amek jubah…Lepas konvo, malam sebelum bergerak balik ke Melaka cik ayue nk jumpe kwn cik ayue kat hostel… dlm pada tggu my fren tiba2 ade sorang minah ni (kecik2 n free hair) berdiri depan cik ayue…

n cakap pasal simkad celcom free… cik ayue malas nk amek tau pasal benda2 mcm nie… stop kan org tengah jalan n paksa2 itu ini… ikutkan ati nak blah je tapi dia pulak btul2 depan cik ayue..nak jalan karang ckp kurang ajar plk kn… so cik ayue pn layan jela minah 2 sbb dia ckp amek mase kejap je xsmpai 5 minit…

M: assalamualaikum kak, bla…bla…bla…10sen panggilan ke semua rangkaian, kita bagi simkad ni free kat akk…akk xperlu bayar pun…

Cik ayue: eh xpela sy nak cepat ni ade hal…

M: kejap je kak..x lame pun akk dengar dulu…rugi akk x dengar coz dh ramai student amek nie…(dats mean dh rmai la yg terkena dgn tipu helah dis girl n the gang)

Cik ayue: (dgn terpaksa) yela…cite la cepat…

M: akk skarang guna berapa no?

Cik ayue: 2, celcom n maxis…tapi yg xtif maxis coz hset celcom rosak…

M: ok, sekarang akk bagi IC sy nak Photostat…kita isi borang dulu…

Cik ayue: eh nk wtpe…sy xcakap pun nak amek simkad free awak 2…xpela…thanks jela…

M: alaa kak..xkan akk xnak, simkad nie sy bg free je kat akk..akk xpyah bayar apepun…

Cik ayue: sy dh ade 2 simkad, watpe nk pkai byk2…nnti nak sumbat mane???

M: akk boleh guna no lame…simkad nie guna no akk la…

Cik ayue: oowh, habis 2 simkad maxis sy ni xleh guna la nnti??

M: akk boleh guna lg…jangan risau..no lame akk still boleh guna...anek la kak, dah rmai student amek xkan akk xnak…rugi akk nnti…sy bg free je kat akk…

cik ayue pn fikir (alaa dia bg simkad free je pun, bkn ade ape2…amek simkad 2 pas2 simpan jela wat pekasam dlm purse)then dengan mls

cik ayue: belasah jela…cepat sket sy nak cepat nie…

then cik ayue bg IC utk si minah 2 g photostat ,isi borang n segala mcm dia nak wat…lantak ko la nak wtpe…mls nk amek tau…

dah dapat simkad 2 cik ayue pn blah, jmpe mmber…

4 hari lepas balik kg, tibe2 maxis anta msej yg lebih kurang berbunyi “ thanks sbb menggunakan perkhidmatan maxis…permintaan anda untuk jadikan no celcom sedang diproses…”

dlm fkiran cik ayue nape pulak maxis anta msej mcm neh…xkan la cik ayue dh x blh guna no mxs lg kot…xkan no ni nak jd no celcom…alamak habis la cik ayue klau no ni jd no celcom…dah la pakej student mesej pn 1 sen jek…

Esoknye memang betul pn simkad maxis cik ayue dh x boleh guna…line terus xde, nak xnk cik ayue trpaksa guna simkad “free” yg minah 2 bg…

n ape yang mengejutkan cik ayue lg…cik ayue try nak check balance coz sbelum ni kredit cik ayue ade lg brape rggt ntah… cik ayue dial la mcm biase nk check balance… *122# n dial… sorry the number you have entered is invalid...eh biar btol…cik ayue try n try lg…still same…

so cik ayue pn try dia *118# boleh pulak..(mmg confirm la dh jd no celcom)

then 8 untuk my account, tup2 kluar

2. payment channel

3. my celcom rewards

APEKAH SUME NIE??? Cik ayue dah marah…no cik ayue sekarang dh jadi BIL…!!! MY GOD!!!

Cepat2 cik ayue inform my dad n told him everything…ayah ckap cik ayue dh terkene…aduhai, TERMENUNG cik ayue, xsgka dlm berjaga2 pn blh jugak terkena…

Bill untuk dis month pn dh sampai..RM 86.05!!!

Kalau guna prepaid pun baru RM 30 or RM 40 sbulan…tgk bil cik ayue baru guna RM 19, tapi bil tggi…

Nanti dh dpt gaji cik ayue nak g celcom centre nak try jd kan mcm simkad dulu…

Pesanan kepada minah 2 or kwan2 dia klau terbaca entry nie!!!
